Client/Attorney relationship

Once you have engaged SUMMIT IP we will represent you in relation to intellectual property matters, in accordance with your instructions.

If instructions are received on behalf of a company or firm, we act for that entity and not for any particular employee or other stakeholder unless otherwise agreed.

 

Fees

We will provide a quote for all new work to be undertaken.  All quotes will include GST (if applicable) and out of pocket expenses including government fees and overseas associate’s charges.

 

Payment In Advance

Unless otherwise agreed or stated, we will require payment in advance for all new applications.  Advance payments will be required to cover expected substantial expenditure, including foreign applications.

Where we request advance payment, we will not continue until payment has been received.

 

Change of Contact Details

To ensure that we receive your instructions in a timely manner, all changes in your contact details must be provided as soon as practical.

Failure to provide changes in contact details may result in official deadlines for renewals and other actions not being meet, which can incur late fees or lead to a total loss of your rights.

 

Confidentiality

We will retain confidentially of all information provided in accordance with the Code of Conduct of the Professional Standards Board (http://www.psb.gov.au).  SUMMIT IP will store your files electronically for a period of 7 years after the completion of the matter, unless the files have been transferred.

 

Environment

We seek to minimise the use of paper and use electronic means wherever possible.  If paper handling is specifically requested we will charge for significant amounts of photocopying/printing or where courier delivery is necessary. 

 

Termination of Relationship

You may terminate the relationship at any time without providing a reason, by providing written instructions. 

We may cease to act for you, if:
- we fail to receive adequate instructions within a reasonable period of time;
- a conflict of interest is identified;
- funds requested in advance or an account have not been paid; or
- it is our opinion that we no longer have a mutual relationship of trust and confidence, or other circumstances.

Upon termination of the relationship, we will advise you of any actions that require immediate attention.  The advice will be sent to the last address given. 

We will provide our final account including any relevant charges for forwarding and closing your file/s.  We will retain all files relating to your matter until the final account has been paid, after which we will forward the files to you or another designated firm.
